These Terms of Use govern your access to and use of the Whitegoods Help Forum at forum.whitegoodshelp.co.uk. Please read them carefully before registering or posting. By creating an account, posting, or otherwise using the Forum, you agree to be bound by these Terms.
1. These Terms
1.1 These Terms of Use (Terms) form a legally binding agreement between you and us. They apply to your use of the Whitegoods Help Forum, including registration, posting, reading, and any associated tools and features (collectively, the Forum).
1.2 These Terms apply in addition to our main Whitegoods Help Terms of Use and our Privacy and Cookie Policy and Forum Privacy Policy, which continue to apply to your use of the wider Whitegoods Help website and services. Where these Forum Terms conflict with the main Terms specifically in relation to the Forum, these Forum Terms take precedence.
1.3 By accessing or using the Forum you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not register for or use the Forum.
1.4 We recommend that you save or print a copy of these Terms. They are available only in English.
2. Who We Are
2.1 The Whitegoods Help Forum is owned and operated by NAC (Domestic Appliances) Ltd (we, us or our), a company registered in England and Wales under company number 07531907.
2.2 Registered office: 4 Calder Close, Calder Park, Wakefield, West Yorkshire, WF4 3BA. Contact: [email protected].
3. What the Forum Is, and What It Is Not
3.1 The Forum is an online community where users can post questions, share experiences, and discuss matters relating to domestic appliances, faults, maintenance and repair.
3.2 The Forum is a discussion platform only. It is not a repair service, a diagnostic service, a professional advice service, or a substitute for the engagement of a qualified engineer or other relevant professional. Content on the Forum is informational and conversational in nature only.
3.3 The Forum is operated separately from our appliance repair business. Nothing posted on the Forum, including any post we make and any output of any automated feature, is given in the course of, or constitutes, professional or technical advice provided by us in our capacity as a repair business, and no engagement, retainer, contract for services, or professional or advisory relationship arises between you and us by reason of your use of the Forum.
3.4 We host the Forum and provide the platform. Except where a post is clearly identified as an official Whitegoods Help post, we do not author, review, verify or endorse the contributions of users. Even where a post is clearly identified as an official Whitegoods Help post, it remains subject to the disclaimer in Section 6, is provided for general information only, and must not be relied upon as professional or technical advice.
3.5 The Forum is provided to users free of charge.
4. Eligibility and Age
4.1 The Forum is intended for users aged 16 and over. By registering, you confirm that you are at least 16 years old.
4.2 If you are under 16, you must not register for or post on the Forum without the supervision and consent of a parent or guardian.
4.3 We do not knowingly collect personal data from children under 13. If we become aware that a child under 13 has registered or provided personal data, we will delete it promptly.
5. Your Account and Security
5.1 To post on the Forum, you must register for an account. You agree that:
- the information you provide on registration is accurate and kept up to date;
- you will keep your password confidential and not share your account with anyone;
- you are responsible for all activity that takes place under your account; and
- you will notify us promptly at [email protected] if you believe your account has been accessed without your authorisation.
5.2 You must not register more than one account without our permission, register an account in someone else's name, or use a username that is offensive, impersonates another person, or infringes any third party's rights.
5.3 We strongly recommend that you do not use your real full name as your public username, and that you do not publish personal contact details in your posts. See our Forum Privacy Policy for more on the public nature of the Forum.
5.4 We may keep a record of your acceptance of these Terms, including the version accepted and the date of acceptance, and you agree that such a record may be relied upon as evidence of the Terms applicable to your use of the Forum.
6. Important Disclaimer: No Professional Advice
6.1 All content on the Forum, including posts, comments, replies, any AI-generated output, any official Whitegoods Help post, and any other material, is for general informational and discussion purposes only.
6.2 Such content does not constitute professional or technical advice and must not be relied upon as a substitute for advice from a qualified appliance repair engineer or other relevant professional. We do not, by hosting the Forum or by any content appearing on it, assume any duty of care or responsibility to you in respect of the accuracy, completeness or suitability of any content, and you should not treat any content as an assurance on which you may rely.
6.3 Posts on the Forum are frequently made by other members of the public who may have no relevant qualifications, training or expertise. We do not check the identity, qualifications or competence of any user, and we do not verify the accuracy of any user's posts.
6.4 You must always consult a qualified engineer before:
- attempting any repair involving gas appliances;
- working on appliances connected to the mains electricity supply; or
- making any repair where safety is a concern.
6.5 Working on gas and electrical appliances can cause serious injury or death. You must always exercise your own independent judgement and, where appropriate, seek qualified professional assistance. Following any content posted on the Forum is entirely at your own risk.
7. User-Generated Content: Your Responsibility
7.1 You are solely responsible for any content you post on the Forum, including text, images, links and any other material (Your Content).
7.2 By posting Your Content, you confirm that:
- it is your own original content, or you have all necessary rights and permissions to post it;
- it is accurate to the best of your knowledge and not misleading;
- it does not infringe the intellectual property rights, privacy rights or any other rights of any third party;
- it is not defamatory, false, abusive, threatening, harassing, obscene, discriminatory or otherwise unlawful;
- it does not contain anyone else's personal data without their consent; and
- it does not contain spam, advertising, or promotional material unless we have given written permission.
7.3 You must not post content that you do not genuinely believe to be true and fair, particularly where it concerns a named business, manufacturer, retailer or individual. Statements of fact about identifiable parties can give rise to legal liability for you as the author.
8. Content from Other Users: Not Verified or Endorsed
8.1 Views and information expressed by users on the Forum are those of the individual users, not of Whitegoods Help or NAC (Domestic Appliances) Ltd.
8.2 We do not:
- verify, endorse or guarantee the accuracy, completeness or quality of any user's posts;
- vet the qualifications or competence of any user offering advice; or
- accept responsibility for any advice, opinion, recommendation or statement posted by any user.
8.3 We act as a host of user-generated content. To the fullest extent permitted by law, we are not liable for content posted by users. Where we are notified of unlawful content and that liability protection applies, we will act expeditiously to review and, where appropriate, remove it (see Section 13).
9. AI-Generated Content and AI Features
9.1 AI features we may provide. The Forum may include features that use artificial intelligence, such as automated suggestions, summaries, search, or assisted answers (AI Features). Any output produced by an AI Feature (AI Output) is generated automatically by software. It is not authored, reviewed, checked, verified or approved by us or by any qualified person before it is displayed to you, and it is not professional or technical advice.
9.2 How AI Output is identified. Where we present AI Output through a named persona, that persona uses the account name WhitegoodsHelp AI and is labelled as an "AI Assistant". That labelling indicates that the answer is generated automatically by software and is not provided by an engineer or by any other qualified person. The WhitegoodsHelp AI account is not an engineer, is not qualified, and does not provide professional or technical advice.
9.3 AI Output is provided on an "as is" and "as available" basis. We give no warranty or representation that any AI Output is accurate, complete, current, fit for any purpose, or suitable for your particular appliance or situation. AI Output may be wrong, misleading or incomplete. The disclaimer in Section 6 applies in full to all AI Output, and you must not rely on AI Output. Any action you take on the basis of AI Output is taken solely at your own risk, and you must exercise your own independent judgement and, where appropriate, consult a qualified engineer or other relevant professional in accordance with Section 6.
9.4 No assumption of responsibility. By making any AI Feature available, we do not assume any responsibility or duty of care to you in respect of AI Output, and we do not hold any AI Feature out as a source of professional, technical or expert advice. AI Output does not represent our opinion, or the opinion of any qualified professional.
9.5 Where AI Output is displayed, it may be accompanied by a notice identifying it as automatically generated and not to be relied upon. The absence of such a notice in any particular case does not imply that the AI Output has been checked or approved by us, and this Section 9 applies to all AI Output whether or not such a notice is shown.
9.6 AI features for moderation. We may also use AI tools to help moderate the Forum and to detect prohibited or unlawful content. We do not guarantee that such tools will identify all such content, and Section 12 applies to any moderation action we take or decline to take.
9.7 AI-generated content posted by you. If you post content that was generated, in whole or in part, by an AI tool (whether ours or a third party's), you remain fully responsible for that content under these Terms as if you had written it yourself. You must not present AI-generated content as the verified opinion of a qualified professional, and you must not use AI tools to mass-produce posts, to spam the Forum, or to generate misleading, false or unlawful content.
9.8 We may, but are not obliged to, label, restrict, edit or remove any content we reasonably believe to be AI-generated.
10. Acceptable Use and Community Rules
10.1 You agree to use the Forum honestly, responsibly and lawfully. You must not:
- post anything unlawful, defamatory, false, abusive, threatening, harassing, hateful, discriminatory, obscene or otherwise objectionable;
- post anyone's personal or private information (we advise against posting your own contact details, and you must never post another person's);
- impersonate any person or organisation, or misrepresent your affiliation with any person or organisation;
- post spam, advertising, affiliate links, or solicit business, without our prior written permission;
- post content that infringes any copyright, trade mark or other intellectual property right;
- use automated tools, bots or scrapers to extract, copy or harvest content or user data from the Forum;
- use the Forum, or content or data obtained from it, to develop, train or improve a competing product or service;
- attempt to gain unauthorised access to the Forum, other accounts, or our systems;
- upload viruses, malware or any harmful code; or
- use the Forum in any way that disrupts, damages or impairs it or other users' use of it.
11. Your Content: Licence to Us
11.1 You retain ownership of Your Content. However, by posting Your Content on the Forum, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sub-licensable and transferable licence to use, store, copy, reproduce, adapt, edit, publish, display, distribute and otherwise exploit Your Content for any purpose connected with our business, including:
- hosting and displaying it on the Forum and across the Whitegoods Help website;
- editing, reformatting, summarising or republishing it (for example as articles, knowledge base entries or Q&A guides);
- using it to develop, improve, operate and train our content, tools and AI systems (in anonymised or aggregated form where it constitutes personal data, see our Forum Privacy Policy); and
- promoting the Forum and our services.
11.2 This licence survives the closure of your account and the deletion of your posts to the extent necessary for our legitimate business and legal purposes. We are not obliged to attribute Your Content to you.
11.3 You confirm that you have all rights necessary to grant this licence, and you waive any moral rights in Your Content to the fullest extent permitted by law.
12. Moderation, Removal and Our Rights
12.1 We may, at our sole discretion and without notice:
- edit, move, lock, hide or remove any content;
- suspend, restrict, or permanently close any account; or
- refuse registration to any person.
12.2 We are under no obligation to monitor the Forum, but we reserve the right to do so. We may use both human moderators and automated tools. We do not guarantee that all objectionable content will be identified or removed, and the presence of content on the Forum does not imply our approval of it.
12.3 To the fullest extent permitted by law, we are not liable to you for any action we take, or decline to take, in moderating the Forum, including removing or editing Your Content or closing your account.
13. Reporting Content and Notice of Complaints
13.1 If you believe that any content on the Forum is unlawful, defamatory, infringes your rights, or breaches these Terms, please notify us promptly at [email protected].
13.2 So that we can deal with your complaint properly and operate any statutory defence available to us, your notice should set out:
- your name;
- the specific content complained of, and a link to where it appears on the Forum;
- a clear explanation of why you consider the content to be unlawful, defamatory or in breach of these Terms, including, where the complaint concerns an alleged defamatory statement, the meaning you attribute to it and why you say it is defamatory, factually inaccurate, or an opinion that cannot be supported;
- your contact details, including an email address; and
- where the complaint concerns an alleged defamatory statement, whether you consent to your name and contact details being provided to the user who posted the content.
13.3 We host user-generated content and rely on the protections available to hosts and to operators of websites under applicable law, including section 5 of the Defamation Act 2013 and the regulations made under it. Where we receive a valid notice of complaint, we will seek to act in accordance with the applicable statutory procedure and timescales, which may include contacting the user who posted the content, providing that user with details of the complaint, and removing or restricting access to the content where appropriate.
13.4 We will review valid reports and take such action as we consider appropriate. Our review of any complaint, and any action or inaction on our part, is without prejudice to our position and shall not be treated as any admission as to the lawfulness of the content, or as to any liability on our part.
14. Historic and Migrated Content
14.1 Some content on the Forum may have been created before the date of these Terms or migrated from previous forums or websites (including archived discussions originally hosted elsewhere). While we aim to review and improve such content over time, we do not guarantee its accuracy, completeness or currency, and to the fullest extent permitted by law we accept no liability for any reliance placed on it.
14.2 You should treat all historic and migrated content as general background only and verify any critical information with an up-to-date professional source.
15. Use at Your Own Risk
15.1 Subject to Section 16, any action you take based on content obtained from the Forum, including user posts, AI Output, official Whitegoods Help posts, or links to third parties, is entirely at your own risk.
15.2 The Forum and all content on it are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
15.3 To the fullest extent permitted by law, we shall not be liable for damage to appliances or property, financial loss, or any other loss or damage arising from reliance on Forum content.
15.4 Nothing in these Terms excludes or limits our liability for personal injury or death caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under the law of England and Wales.
16. Limitation of Liability
16.1 To the fullest extent permitted by law, we exclude all liability, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any loss or damage arising from or in connection with your use of, or inability to use, the Forum, including:
- any reliance on any content, whether posted by other users, generated by an AI Feature, contained in an official Whitegoods Help post, or otherwise;
- damage to appliances or property and any financial loss;
- loss of data, profits, revenue, business, goodwill or anticipated savings;
- any dispute between you and another user; and
- any indirect or consequential loss.
16.2 Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot lawfully be excluded or limited.
16.3 To the extent that any liability cannot lawfully be excluded but may lawfully be limited, our total aggregate liability to you arising from or in connection with the Forum, however arising, shall be limited to one hundred pounds (£100).
16.4 You acknowledge that the Forum is provided free of charge, and that the allocation of risk in these Terms is reasonable having regard to that fact and to the informational and discussion nature of the Forum.
16.5 If you are a consumer, these Terms do not affect your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation, and nothing in this Section operates to exclude or limit any right or remedy that may not lawfully be excluded or limited as against a consumer.
17. Indemnity
17.1 If you use the Forum otherwise than as a consumer (for example, in the course of a business, trade, craft or profession), you agree to indemnify and hold harmless NAC (Domestic Appliances) Ltd, its officers, employees and agents from and against all claims, losses, costs, damages and expenses (including reasonable legal costs) arising out of or in connection with Your Content, your breach of these Terms, or your misuse of the Forum.
17.2 If you use the Forum as a consumer, you will be responsible for losses we suffer that are caused by your breach of these Terms or your misuse of the Forum, but only to the extent that those losses were a foreseeable consequence of the breach or misuse, and only to the extent permitted by law. Nothing in this Section 17 affects your statutory rights as a consumer.
17.3 This Section 17 applies in particular to any claim brought by a third party in relation to content you have posted, including any claim of defamation or of infringement of intellectual property or other rights.
18. Intellectual Property
18.1 All intellectual property rights in the Forum platform, design, branding and our own content belong to us or our licensors. Nothing in these Terms grants you any rights in our intellectual property except as expressly stated.
18.2 You may view and use the Forum for personal, non-commercial purposes. You may not reproduce, republish, distribute or commercially exploit Forum content (including other users' content) at scale, or copy, extract or scrape content or data.
19. Third-Party Content and Links
19.1 The Forum may contain links to third-party websites, products or services posted by us or by users. We do not endorse those third parties, guarantee the accuracy of their content, or, to the fullest extent permitted by law, accept liability for their products or services. Your use of any third-party website or service is subject to that third party's own terms.
20. Availability of the Forum
20.1 We aim to make the Forum available at all times but do not guarantee that it will always be available, uninterrupted or error-free. We may suspend, withdraw, restrict or modify the Forum, or any part of it, at any time without notice, and to the fullest extent permitted by law we are not liable to you for doing so.
21. Suspension and Termination
21.1 We may suspend or close your account, or restrict your access to the Forum, at any time if we reasonably believe you have breached these Terms or where we consider it necessary to protect the Forum, other users or us.
21.2 You may stop using the Forum and request closure of your account at any time. Closure of your account does not affect the licence granted in Section 11, our right to retain content for legal and operational reasons, or any rights or liabilities accrued before closure.
22. Changes to These Terms
22.1 We may update these Terms from time to time. Changes take effect when published, and the date at the top of this page will be updated accordingly. Your continued use of the Forum following any update constitutes your acceptance of the revised Terms. If you do not agree to any change, you must stop using the Forum.
23. General
23.1 Entire agreement. These Terms, together with our main Terms of Use and our Privacy and Cookie Policy and Forum Privacy Policy, constitute the entire agreement between you and us in relation to your use of the Forum, and supersede any prior agreement, understanding or representation. Nothing in this clause limits or excludes any liability for fraud or fraudulent misrepresentation.
23.2 No reliance. Save as expressly set out in these Terms, you confirm that you have not relied on any statement, representation, assurance or warranty in agreeing to these Terms or in using the Forum.
23.3 Severability. If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity of the remaining provisions, and the offending provision shall be read down to the minimum extent necessary to make it lawful and enforceable.
23.4 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
23.5 Assignment. You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations under these Terms to another business.
23.6 Third parties. No one other than us or you has any right to enforce any of these Terms, save that our officers, employees and agents may enforce Section 17.
23.7 Consumer rights. Nothing in these Terms is intended to limit or exclude any rights you have as a consumer under the law of England and Wales, including under the Consumer Rights Act 2015.
24. Governing Law and Jurisdiction
24.1 These Terms are governed by the law of England and Wales. Any dispute arising from these Terms or your use of the Forum shall be subject to the jurisdiction of the courts of England and Wales, except that if you are a consumer resident in another part of the UK, you may also benefit from any mandatory protections afforded by the law of that part.
