10 Days To Fix A Machine
Hi, I purchased washing machine from a large retail company 9 weeks ago, mid wash it decided to die, phoned retailer and they said they couldnt come until 7 days later, on the seventh day a engineer turned up stripped the machine down and said the pcb had failed and he would be back to fit it in 10 days, as we are a family of 4 adults which one is a funeral director, one is a manager of a coffee shop one working on a building site and the other at school, so we all need lots of clean clothes. Is it me or does this seem unreasonable? i would also like to know am I within my right to ask for a new machine (sprouting off sales of goods act 1974 or by saying it obviously had an inherant problem from new)
The engineer is going to phone tomorrow and let us know if he can get the part soon, i dont have a problem with the engineer from what i can make out he's the one and only engineer for the retail company in 2 or maybe 3 counties in the south west.

Under modifications to the sale of goods act, if a product fails within the first 6 months it is assumed it was sold with an inherent fault. They would have to prove it wasn't, just as after 6 months the onus falls onto the consumer to prove it. However, there is provision within the act for a retailer to be able to claim it's unreasonable to have to exchange such a large expensive appliance if it's a minor fault and easily fixed. But as it's failed after 9 weeks and they can't fix it within what most people would accept as a reasonable time you may be able to persuade them to exchange it.
Alternatively you also may be able to claim compensation for having to use a laundrette for example.You should take further advice from a consumer advice body. Expect resistance to your requirements.

Thanks Andy, we will just have to eek it out for another 9 days I guess, just to let you know the engineer didnt phone today as promised so that was a wasted day sat by the phone, seriously thinking of buying another machine, i can see this is gonna be one of those machines that break down every other month, lol, bought this brand machine for the last 25 years, the times they are a changing.
